A Restrictive Covenant is a legally binding agreement that places limitations on what property owners can do with their land. It is a property right that overrides land use by-laws.
There are currently several dozen Calgary communities exercising similar options including: Lake Bonavista, Rideau, Roxboro, Kelvin Grove, Chinook Park, Eagle Ridge, Elbow Park, Bel-Aire, Varsity and Mayfair.
This covenant is registered on the property's title and remains in effect even after the property is sold.
Lakeview Restrictive Covenant Registration Process
If you have made the decision to registration your property in Lakeview for a Restrictive Covenant, please follow the below steps.

The Lakeview Restrictive Covenant (RC) Volunteer Committee is assisting Carbert Waite LLP in this process to keep costs to a minimum. Please email lakeviewrestrictivecovenant@gmail.com to express your interest in having a restrictive covenant registered on your property.

A member of the RC Volunteer Committee will email you back to gather the following information for Carbert Waite LLP. This information is required to prepare the restrictive covenant for your property.

Sign the release of liability and waiver of claims
3. Send payment of $750 to Carbert Waite LLP in order to have your RC prepared. There are two options for payment:

Interac E-Transfer: please send the e-transfer to etransfer@carbertwaite.com and ensure you assign the password as CarbertWaite. Put your name, address and our file number (125163.001) in the comments section of the transfer.

Payment via cheque. Ensure that your address and our file number (125163.001) are written on the memo line of the cheque. These can be mailed to Carbert Waite (Suite 2300, 645 7th Avenue S.W., Calgary, Alberta, T2P 4G8) for arrival by June 12th, 2025
OR let the RC Volunteer Committee know that you would like to arrange to pay by cheque when providing your property details. We can pick up your cheque and take a batch to Carbert Waite. Once Carbert Waite LLP receives payment, they will review titles, prepare the restrictive covenant for your property and have it ready to be signed. Once completed, Carbert Waite will submit your RC for registration.
NOTE: Restrictive Covenant Packages will not be prepared for properties where payment has not been received.
